By accessing this website, purchasing or using any WildCore™ product, or creating an account on the WildCore™ cloud portal, you agree to be bound by these Terms of Use and all policies referenced herein. If you do not agree, do not use the site, products, or services. If you are using the services on behalf of a business or other entity, you represent that you have authority to bind that entity to these terms.
"Company," "we," "us," or "our" means Concurrent Design, Inc. "Products" means WildCore™ feeder controllers and related hardware and accessories. "Services" means the WildCore™ cloud portal, firmware, software, and related online features. "You" or "user" means the person or entity using the site, Products, or Services.
You agree to use the Products and site only for lawful purposes and in accordance with these terms, all applicable manuals and instructions, and all applicable laws and regulations. You are solely responsible for the proper installation, configuration, power supply, mounting, weatherproofing, and maintenance of any Product you deploy.
Certain features require an account and an active service plan. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Service plans, where offered, are billed as described at the point of sale. Local scheduling functions stored on a Product may continue to operate when a cloud service plan lapses, but cloud-dependent features (remote configuration, reporting, firmware updates, and notifications) require an active plan. We do not guarantee uninterrupted availability of the Services.
THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, EXCEPT AS EXPRESSLY STATED IN THE LIMITED WARRANTY BELOW. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Products or Services will be uninterrupted, error-free, secure, or free of harmful components, or that defects will be corrected. Connectivity features depend on third-party cellular, satellite, Wi-Fi, GPS, and internet services that are outside our control.
WildCore™ Products control feeding and related equipment. You acknowledge and accept the following:
You are responsible for ensuring that your deployment and use of the Products complies with all applicable federal, state, and local laws, including wildlife and game regulations, agricultural rules, property and lease terms, and radio-frequency and telecommunications regulations. Radio-equipped Products are intended to be operated in compliance with applicable regulatory authorizations for the region in which they are used. Unauthorized modification of a Product may void regulatory authorizations and the warranty, and may be unlawful.
Concurrent Design, Inc. warrants that Product hardware will be free from defects in materials and workmanship under normal use for a period of one (1) year from the date of original retail purchase, unless a different period is stated at the point of sale. This warranty extends only to the original purchaser and is non-transferable.
Our sole obligation, and your exclusive remedy, under this limited warranty is, at our option, repair or replacement of the defective Product, or refund of the purchase price. To request warranty service, contact us using the details below with proof of purchase. THIS LIMITED WARRANTY IS THE ONLY EXPRESS WARRANTY WE PROVIDE; ALL OTHER WARRANTIES ARE DISCLAIMED TO THE EXTENT PERMITTED BY LAW. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and you may have other rights that vary by jurisdiction.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CONCURRENT DESIGN, INC., ITS OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, ANIMALS, LIVESTOCK, CROPS, OPPORTUNITY, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, PRODUCTS, OR SERVICES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SITE, PRODUCTS, OR SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT, OR (B) FIFTY U.S. DOLLARS ($50). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless Concurrent Design, Inc. and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use or misuse of the site, Products, or Services, your violation of these terms, or your violation of any applicable law or the rights of any third party.
The WildCore™ name and logo, the site, the Services, firmware, software, and all related content are owned by or licensed to Concurrent Design, Inc. and are protected by intellectual property laws. Patent applications may be pending. No rights are granted to you other than a limited, revocable, non-exclusive license to use the Products and Services for their intended purpose. You may not use our marks without prior written permission. Other product names and trademarks referenced on the site, including those of distribution partners, are the property of their respective owners.
We collect information you provide (such as account details and orders) and information generated by your Products (such as device telemetry, status, location where enabled, and event logs) in order to provide the Services. We use this information to operate and improve the Products and Services, fulfill orders, provide support, and communicate with you.

The Products and Services rely on third parties for cellular, satellite, Wi-Fi, GPS, mapping, payment, and shipping functions. We are not responsible for the availability, accuracy, performance, terms, or policies of any third-party service, and your use of those services may be subject to their own terms.
We may update these terms from time to time. The "Last updated" date above reflects the most recent revision. Your continued use of the site, Products, or Services after changes are posted constitutes acceptance of the revised terms.
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that the exclusive venue for any dispute arising out of or relating to these terms, the site, the Products, or the Services will be the state or federal courts located in Brevard County, Florida, and you consent to the personal jurisdiction of those courts. If any provision of these terms is found unenforceable, the remaining provisions will remain in full force and effect.
